Start with the right court and forms

NRS 73.010 allows money claims up to $10,000 in justice court. Venue can depend on where the defendant lives, works, or does business, or where a contractual obligation was to be performed. Select the township before selecting a complaint form. A Clark County form is not automatically the right form for Reno or another Nevada court.

I vacated the above rental property on August 01, 2026 and paid a security deposit of $1,600.00. Under Nev. Rev. Stat. § 118A.242 (Nevada Security Deposit Law), the applicable return rule is: No later than 30 days after termination the landlord must provide an itemized written accounting of the deposit's disposition and return the remainder, personally or by mail.

I dispute the following deductions under Nev. Rev. Stat. § 118A.242 for the reasons below. Please provide the records supporting each disputed charge, including the work, cost, and condition at issue. For replacement charges, explain the item's age and how you calculated the amount charged:

  • Carpet replacement for ordinary wear - $900.00
    Ordinary wear and tear - not deductible. Carpet wear from normal use is not deductible. For a replacement charge, ask for the carpet's age, prior condition, and how the amount was calculated.

I do not contest the following deductions, totaling $300.00: Unpaid rent balance ($300.00).

This demand does not cancel any accepted debt. Any separate claim or counterclaim must credit amounts already paid or retained toward that debt.

This demand is limited to the amount improperly withheld. The applicable statutory remedy is conditional: under Nev. Rev. Stat. § 118A.242(6), your failure to comply makes you liable for the entire deposit plus a further court-fixed sum of up to the entire deposit - a total exposure of up to twice the deposit. I reserve the right to seek that remedy if its conditions are established in court.

Please deliver payment to the address above no later than September 22, 2026 (14 days from the date of this letter). This requested date does not shorten any statutory notice or cure period. If this remains unresolved after the applicable notice, service and waiting requirements are satisfied, I intend to file suit in small claims court. Filing, judgment and collection

  1. File in the selected township

    Use the court-stamped complaint bearing the scheduled date for service. Keep the demand evidence among your attachments, but arrange service of the lawsuit as its own step.

    Service and proof

    Serve the filed complaint using an authorized method, ordinarily through the constable, a process server, or an eligible nonparty adult. Rule 91 requires service at least 14 days before trial and proof filed immediately after service. Check your court's notice for any earlier mediation or local filing requirement; a demand-letter receipt is not proof that the complaint was served.

  2. Build the exhibit stack

    Start with an accounting of the deposit, refund, accepted charges, and disputed charges. For a cleaning or repair deduction, pair the charge with condition photographs and the landlord's supporting records. If you request additional damages under NRS 118A.242, give the court the facts supporting that discretionary request rather than presenting the maximum as an automatic award.

  3. How your case is decided

    The first appointment differs within Clark County: Las Vegas schedules trial, while North Las Vegas requires mediation before a trial is set if settlement fails. Henderson may require an attempt at mediation on the hearing date. Bring the evidence and follow the appointment named in your own notice.

Counterclaims and review options

A landlord can raise a counterclaim, so bring records addressing accepted charges as well as disputed deductions. Rule 98(b) gives 7 calendar days from service of the judgment to file a notice of appeal, calculated under Rule 6. No formal notice of entry is required; Rules 99 and 100 govern the form and bond. Preserve the date and method of service of the judgment instead of assuming the clock starts when you later read it.

Compare a civil claim with reducing your request to $10,000. Understand what you waive; do not split one claim to avoid the limit.

What happens if my landlord doesn't show up to the hearing?

The court may enter default after proper service and proof of your claim. Follow its default instructions and attend any scheduled hearing unless the court excuses you.

How long does a small claims case take in Nevada?

Timing depends on service, the court's calendar and any mediation. Follow the response and hearing notices for your case; filing alone does not guarantee a trial date.

Can my landlord retaliate against me for suing?

Keep records of threats and check your state's retaliation protections if you still rent there. A deposit claim differs from eviction, but court records may be public.

Is a Las Vegas mailing address enough to choose Las Vegas Justice Court?

Must I wait 10 days after a demand in Las Vegas?

Will North Las Vegas hear my evidence at the first appointment?

Can I split a deposit claim above $10,000 into two Nevada cases?
